HOLIDAY SEASONS
Peak Season - 22 December 2007 to 29 January 2008
Bookings are a minimum 7 night sfrom Saturday to Saturday
Shoulder Season - 30 January 2007 to 31 May 2007  /  1 September 2007 to 21 December 2007
Off Peak Season - 1 June 2007 to 31 August 2007


A.      HOLDING DEPOSIT:  As agreement to the above-mentioned terms, and confirmation of the tenant’s intent, a holding deposit, to the amount of 50% of the total tariff will be paid to the Managing Agent by the tenant, on booking.

B.       SECURITY BOND:  A bond of $1000.00 cleared funds per property will be held by the Managing Agent until the expiration of this Tenancy and, if required, shall be used to replace articles of equivalent value, any furniture effects, fittings or building that may become damaged or lost during this tenancy.  The bond may also be used to cover extra cleaning costs and/or rubbish removal if necessary. 

 

 

C.      BOND REFUNDS:  This bond will be refunded within seven (7) working days from the date of departure (unless a problem is encountered) to the nominated bank account/credit card, details as follows:

 

 



 
D.      CLEANING:  The premises will be professionally cleaned when you depart and the fees have been included in your tariff.  Extra cleaning charges will be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of rubbish etc.  Should the cleaning fee be more than the usual cost for cleaning the property, the tenant will be charged the additional costs over and above the normal cleaning fee.  All furniture and furnishings should be left in the position they were in when you arrived, otherwise an additional  fee will be charged.

 

 

E.        BALANCE:  The Tenant further agrees to pay all outstanding monies pertaining to this Agreement, thirty (30) days prior to taking occupation of the above property. Please note that all money paid to the Agent must be in Australian dollars only.

 

 

F.        PAYMENT OPTIONS: We accept Visa, MasterCard, direct deposit into our bank account, bank cheque or money order for holiday accommodation/security bond payments. Personal cheques will only be accepted if received at least 14 days prior to arrival. CASH PAYMENTS WILL NOT BE ACCEPTED,

 

 

G.      CANCELLATION:  Part cancellation of a booking will not be accepted.  Should the tenant cancel the booking, the tenant will only be entitled to a refund of any monies paid, LESS a cancellation fee of $250.00 when the accommodation is re-let for the whole term of the Agreement at full rent.  The landlord may cancel at any time prior to the letting, in which case the tenant will receive a full refund.

 

 

H.       REPRESENTATIVES:  Should a Representative be acting on behalf of the Tenant, it is deemed that their decision on the said property is final, and the Agent will not be held accountable for their decision. 

 

 



                                                    

 

 



 

 

THE TENANT FURTHER AGREES:

 

 



 

 

1.             To maintain and leave the premises in a clean, tidy and undamaged condition. 

 

 

2.             To pay the rent prescribed herein in advance as per the above stated conditions.

 

 

3.             That the said premises or any part thereof shall not be used for any purpose other than as holiday accommodation and that no more than the said property sleeps are to be accommodated. Occupancy of more than the stated number of persons will render the tenant liable to immediate cancellation of the booking or eviction.  No accommodation monies will be refunded in the event of eviction.

 

 

4.             Not to assign or sub let the whole or any part of the subject premises.

 

 

5.             That all damages, breakages and losses to the holiday premises and/or furniture, furnishings and lock and key replacements are to be reported to the Agent immediately.  The Tenant shall be responsible for any damages or breakages and these must be paid for by the Tenant.

 

 

6.             Not to remove any of the furniture or effects from the premises.

 

 

7.             To allow the Landlord or Agent to enter and view the state of repair of the premises, and the Tenant will be responsible for any damage caused to the premises.

 

 

8.             That pets are not permitted on or in the vicinity of the holiday premises.  If pets are found the Tenant will be liable for the cost of cleaning and/or fumigating the premises and the tenancy shall be terminated.

 

 

9.             That fish or any other seafood are not to be cleaned on the premises.

 

 

10.          That no responsibility is taken for Tenant’s personal property left on the premises and such property may be disposed of immediately by the Landlord or Agent.

 

 

11.          That the tenant or any persons using the premises shall not conduct themselves in a manner which is a nuisance or annoyance to adjoining or neighboring occupiers and shall comply with the requirements of all statutory laws, regulations and By-Laws applicable in respect of the premises.

 

 

12.          To thoroughly fumigate and disinfect the premises, at the Tenants expense, and to the satisfaction of the Agent, in the event of any infectious illness occurring during the Tenancy.

 

 

13.          The tenant further agrees to not use the premises for functions/weddings/parties etc. unless prior permission granted.

 

 

14.          Place the garbage bin out at street level for collection on Thursday nights. Any surplus garbage not removed by the Tenant from the premises, will attract an additional charge for removal.

 

 

15.     Please collect the keys from our office - Shops 1 & 2/1 Campbell Crescent, Terrigal between 2.00pm and 5.00pm.  Should you arrive after 5.00pm and before 8.30pm a $50 fee will apply, as someone will need to meet you at LJ Hooker Terrigal on your arrival.  If you arrive after 8.30pm you will need to make alternative accommodation arrangements for the night and check-in the following morning from 9.00am.  No refunds for the missed night will be issued.

 

 

15.          To only smoke outside the rented premises and to dispose of butts in the ash trays provided.

 

 

16.          That at the time of the booking, the Landlord/Agent will describe the premises and position to the best of their ability and in good faith and as accurately as possible and that no responsibility or refund for alleged mis-description can be accepted.

 

 

17.          Should the Tenant default under the terms of this Agreement, then the Agent may re-enter the subjected premises after notice to that effect has been given.

 

 

18.          When the tenant has collected the keys or a guest of the tenant enters the property they shall be deemed to have agreed to be bound by these conditions.

 

 

19.          The tenant authorises the Managing Agent to deduct monies from the bond should damages to the property occur or any breaches of the conditions arise during the period of occupancy.  Should a deduction be made, you will be notified of the reason & amount deducted.

 

 

20.          If the agent is required to attend the property on the tenants request ie.keys locked in the property, the tenant further agrees to pay the agent a $50 call-out fee.

 

 

21.          If it is brought to the attention of the agent that the booking is one of a “Schoolies” or “Buck’s party” nature the agent has the right to cancel the booking immediately and the full amount of accommodation will not be refunded.  The agent will also evict all persons from the property immediately.

 

 

Failure to comply with the above terms and conditions may result in an eviction and therefore forfeit any accommodation and bond monies.

 

 



 

 

PLEASE NOTE:  Bed linen & towels are not provided in most Holiday Properties.  Please ensure you bring sheets & towels with you if the property does not supply linen.  Linen hire is available through the Terrigal Launderette on 4384 5653.
