LJ Hooker Franchising Pty Limited (ABN 61 003 890 453) of Lvl 26, 161 Castlereagh Street, Sydney NSW 2000
The period between 9:00am AEST on Monday 17th July 2023 and 5:00pm AEDT on Tuesday 31st October 2023.
Investment Property means a residential property located in Australia that generates rental income.
Rental Appraisal means an approximation of rental income to be generated from the Investment Property each week.
LJ Hooker Franchisee means a qualified real estate agent authorised to operate within the LJ Hooker franchise network, as may be located at the website: https://www.ljhooker.com.au/find-an-agent.
Landlord means the registered owner on title of an Investment Property.
Managing Agency Agreement means an executed, written contract with an LJ Hooker Franchisee for the provision of property management services for the Investment Property that is compliant with all legislation and regulations relevant to the conduct of a real estate agent in the home state of the location of the Investment Property.
Management Fees means the management fee payable to the LJ Hooker Franchisee for property management services pursuant to an executed Managing Agency Agreement for the Investment Property and does not include (without limitation):
· Costs of repairs and maintenance to the Investment Property
· Costs for advertising, marketing or promoting the Investment Property
· Outgoings for the Investment Property
· Letting, Administrative or Statement Fees
· Other charges, expenses and third-party costs payable under the Managing Agency Agreement
The Promotion is open to Australian residents aged 18 years or older at the time of entering the Promotion who are the Landlord of an Investment Property and who are not:
a. party to an existing Managing Agency Agreement (entered into prior to the commencement of the Promotion Period) with an LJ Hooker Franchisee for the same Investment Property;
b. directors, officers, management members or employees (and the immediate family members of directors, officers, management members or employees) of the Promoter or any of its franchisees or associated companies; or
c. otherwise involved in the conduct or management of the Promotion.
To enter the Promotion, Eligible Entrants must, during the Promotion Period:
a. Book and complete a physical or virtual appointment with an LJ Hooker Franchisee to provide a Rental Appraisal of an Investment Property for which they are the Landlord; and
b. Enter into a Managing Agency Agreement for the Investment Property with the LJ Hooker Franchisee who conducted the Rental Appraisal for a minimum term of 12 months; and
c. Provide their full name, contact number, email address and postcode of their primary residence in Australia to the LJ Hooker Franchisee with which they entered into the Managing Agency Agreement,
Each Eligible Entrant with a Qualifying Entry will be entered in the Prize Draw.
There will be one (1) prize and the winner (Prize Winner) will receive up to 12 months of property management services up to the total value of AU$2,500.00, to cover Management Fees payable under the Managing Agency Agreement that was executed as part of the Qualifying Entry.
The 12 month period commences on the 1st day of the next month following the Prize being claimed in accordance with the Terms and Conditions.
A random electronic draw of all Qualifying Entries will take place at Lvl 26, 161 Castlereagh Street, Sydney NSW 2000 at 1:00pm AEDT on Wednesday 8th November 2023, and one (1) Qualifying Entry will be drawn.
The draw will be conducted by the Promoter and will be entirely random.
Unclaimed Prize Draw
If the Prize is not claimed by the winner of the Prize Draw in accordance with the Terms and Conditions, an unclaimed prize draw will be held on Wednesday 29th November 2023 at the same time and place as the original Prize Draw. All Qualifying Entries (except the Qualifying Entry drawn in the Prize Draw) will be entered in the unclaimed prize draw and one (1) Qualifying Entry will be randomly drawn.
Winner Notification and Claiming the Prize
The Promoter will, within 2 business days of the Prize Draw, notify the winner of the Prize Draw in writing by email via the email address provided as part of the Qualifying Entry. The winner of the Prize Draw must claim the Prize within 14 days of being notified, by confirming their acceptance of the Prize to the Promoter in writing to firstname.lastname@example.org .
If the winner of the Prize Draw fails to claim the Prize in accordance with the above, the winner will be taken to have forfeited the Prize and the Promoter will then offer the Prize to the winner of the Unclaimed Prize Draw.
The Promoter will notify the winner of the Unclaimed Prize Draw in writing by email, via the email address provided as part of the Qualifying Entry. The winner of the Unclaimed Prize Draw must claim the Prize within 4 days of being notified by confirming acceptance of the Prize to the Promoter in writing to email@example.com.
Publication of Winners
The name (surname and initial of fist name) and postcode and/or State/Territory of residence of the Prize Winner will be published on www.ljhooker.com.au within 2 business days of the Prize Draw and/or Unclaimed Prize Draw.
General Terms and Conditions
By entering the Promotion, entrants agree to be bound by the Terms and Conditions of the Promotion, which consist of these General Terms and Conditions and the terms set out in the Promotion Details.
No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
The Promoter is not responsible for any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
It is a condition of entry into the Promotion that entrants provide the Promoter with their correct first and last name, and valid contact number and email address. Where an entrant's contact details change at any time after entering the Promotion and before the date of the Prize Draw, the entrant must notify the LJ Hooker Franchisee with which they entered into the Managing Agency Agreement (via the contact details included in the Managing Agency Agreement or as otherwise notified to the entrant) of their correct contact details immediately. Any entries will be void if the correct contact details are missing or invalid. The Promoter is not responsible for any incomplete or incorrectly submitted details provided by an entrant.
The Promoter reserves the right, at any time, in its sole discretion to verify the validity of entries and eligibility of entrants (including an entrant's identity, age, place of residence and any other details forming part of an entrant's eligibility or the Entry Requirements) and to require an entrant to provide proof or documentation to confirm an entrant's eligibility to enter the Promotion and claim the Prize.
The Promoter reserves the right to disqualify any entrant whom the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an entrant are reserved.
The results of the Prize Draw (and any Unclaimed Prize Draw) are final and no correspondence will be entered into.
It is a condition of accepting Prize that the Prize Winner agrees to: (a) the publication of their name, postcode and/or State/Territory of residence in accordance with these Terms and Conditions; (b) participate in all publicity reasonably requested by the Promoter in connection with the Promotion (and the Prize); (c) consent to the use of their name, image and likeness in any media for an unlimited period without remuneration in connection with the Promotion (and the Prize), and for promotional purposes related to the Promoter and/or its franchisees; and (d) at the Promoter's reasonable request, do all things necessary (including signing all documentation) necessary to give effect to this clause and/or to enable the Promoter to provide any part of the Prize.
The Prize must be taken as stated and no compensation will be payable if the Prize Winner is unable to use the Prize as stated. The Prize is not transferable or redeemable for cash or other goods or services. The Prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting the Prize that the Prize Winner accepts the conditions of use of the Prize.
The Promoter accepts no responsibility for any variation in the value of the Prize, or any costs or expenses associated with use of the Prize.
If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize (or part thereof) to the equal value and/or specification, subject to any directions from a regulatory authority.
A failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If for any reason the Promotion is not capable of running as planned (including, but not limited to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may take any action that it considers necessary including cancelling, terminating, modifying or suspending the Promotion without any further obligations to any entrants or the Prize Winner.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any similar consumer protection laws in the states and territories of Australia (Non-Excludable Guarantees).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, its franchisees and related entities (including its respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in the Prize or Prize value to that stated in these terms; (d) any tax liability incurred by a beneficiary of the Prize; (e) any use or taking of the Prize; or (g) the Promotion.
Complaints regarding the Promotion may be submitted by email to firstname.lastname@example.org. If there is a dispute concerning the complaint, the decision of the Promoter will be final and no further correspondence will be entered into.
Qantas Terms & Conditions
* You must be a member of the Qantas Frequent Flyer Program to earn points. Membership and points are subject to the Qantas Frequent Flyer program terms and conditions. In order to earn points, your residential property must be listed and sold or leased exclusively with LJ Hooker in Australia. This offer cannot be used in conjunction with any other rewards program in which LJ Hooker participates. Your Qantas Frequent Flyer membership number and the number of points you will receive after settlement must be clearly agreed on at the time of the exclusive listing and clearly stated in your LJ Hooker exclusive agency agreement for sale of your property. If no reference is included, points will not be allocated. Qantas Points will be credited to the person/s on the exclusive agency agreement.
** Value is based on a sample Qantas Frequent Flyer reward that could be obtained by redeeming through the Qantas Frequent Flyer program. The estimate of maximum notional value of 1.2 billion Qantas Points is provided for information purposes only and will vary depending on whether and how it is redeemed through the Qantas Frequent Flyer program. The value is in Australian Dollars. For example, 36,000 Qantas Points could be redeemed for a return Economy Classic Flight Reward from Sydney to Perth plus AU$43 in applicable taxes, fees and carrier charges, accurate as at 4 August 2021.

If the number of Qantas Points are not agreed at the time of listing, Qantas Points will not be awarded.
**** This is a once-only, per property point’s allocation based on a minimum 12-month management agreement and does not apply to properties currently managed by any other LJ Hooker office. You must be a Qantas Frequent Flyer member at the time of signing your management agreement to be eligible. Points must be agreed to at the time of signing a new management agreement if they are not they will not be awarded. To redeem points the name on the management agreement must match the name on the Qantas Frequent Flyer membership card. If the name does not match then the points will not be transferred. The number of Qantas Points the landlord is entitled to must also be clearly stated on the management agreement at the time. If the number of Qantas Points are not agreed at the time of new management, Qantas Points will not be awarded.
